Sinkfield v. Persolve Recoveries, LLC, No. 9:21-cv-80338-RKA (S.D. Fla. Oct. 17, 2022)


If Persolve Recoveries, LLC (“Persolve”) filed a lawsuit against you in a Florida court between February 16, 2020 and February 9, 2021, you may benefit from the settlement of this class action lawsuit.
 
A consumer sued Persolve alleging that it filed lawsuits against consumers in Florida even though it was not registered as a consumer collection agency with the State of Florida Office of Financial Regulation, in violation of the federal Fair Debt Collection Practices Act. Persolve expressly denies any liability, or that it violated the FDCPA, but has agreed to a settlement to avoid the expense and uncertainty of continued litigation.
 
A settlement will provide $20,000.00 (the “Settlement Fund”) to fully settle and release claims of a class of persons who Defendant sued in a Florida court between February 16, 2020 and February 9, 2021 in connection with the collection of a consumer debt.
 
The Settlement Fund created by Defendant will be used to pay pro-rata settlement awards to all participating class members. Defendant separately will pay statutory damages to the named plaintiff, class counsel’s attorneys’ fees, costs, and expenses, as well as the costs of notice and administration of the settlement.
 
The Court granted preliminary approval to the settlement on October 17, 2022 and granted final approval in January 2023.
